These Terms of Service ("Terms") govern your use of the FraudFalcon fraud detection application ("App", "Service") provided through the Shopify App Store. By installing and using our App, you ("Merchant", "you") agree to be bound by these Terms.
FraudFalcon is a Shopify app that allows merchants to configure automated fraud detection rules. When orders match your configured patterns (such as specific names, IP addresses, or address patterns), the App can automatically cancel those orders through the Shopify API.
You acknowledge and agree that:
You are solely responsible for configuring all fraud detection rules and settings within the App
You must ensure your fraud detection rules comply with applicable laws, including anti-discrimination laws
You are responsible for monitoring the App's performance and adjusting rules as needed
You must review and approve all automated actions before enabling them
You are responsible for communicating with affected customers regarding cancelled orders
Important: Please read this section carefully as it limits our liability to you.
We provide the App "as is" without warranties of any kind. We shall not be liable for any financial damages, lost revenue, or business losses resulting from:
Misconfigured fraud detection rules
False positive detections
False negative detections
App malfunctions or downtime
Cancelled legitimate orders
Approved fraudulent orders
Our liability to you is excluded to the fullest extent permitted by law.This limitation applies regardless of the legal theory of liability.
You agree to indemnify, defend, and hold us harmless from and against any claims, damages, losses, costs, or expenses (including reasonable attorney fees) arising from or related to:
Your use or misuse of the App
Your configuration of fraud detection rules
Claims by customers whose orders were cancelled by the App
Your violation of these Terms or applicable laws
Any discriminatory or unlawful fraud detection rules you implement
We strive to maintain high service availability but do not guarantee uninterrupted service. The App's effectiveness depends on proper configuration and may not detect all fraudulent activity. We reserve the right to modify App features with reasonable notice.
We may update these Terms from time to time. Continued use of the App after the effective date constitutes acceptance of the new Terms. If you disagree with the changes, you may terminate your subscription before the effective date.
Either party may terminate this agreement. You may cancel your subscription at any time through your Shopify admin or by uninstalling the App. We may terminate your access if you violate these Terms or engage in fraudulent activity. Upon termination, all fraud detection rules will be deactivated. No refunds will be provided for partial billing periods.
This App is provided as a business-to-business (B2B) service. You represent that you are a business entity or acting on behalf of a business entity, and consumer protection laws do not apply to this agreement.
These Terms are governed by German law. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Munich, Germany (Gerichtsstand: München).

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
